The scandal surrounding Stormy Daniels, the adult film actress who claims to have had an affair with Donald Trump, just got worse.
It started when David Schwartz, an attorney for Donald Trump’s attorney Michael Cohen, appeared on CNN last night. Schwartz told CNN’s Erin Burnett that Trump “was not aware of” the non-disclosure contract signed by Stormy Daniels and “wasn’t told about it.”

Schwartz’s argument is that there was a binding contract between Daniels and EC LLC, the shell corporation set up by Michael Cohen, and Trump was a “third party beneficiary” of the contract.
The problem for Schwartz, Cohen, and Trump is that the contract was not constructed in a way to make that possible. Part of the inducement for Daniels to sign the contract, explicitly, were things that only Donald Trump himself (referred to in the contract, and by Schwartz, as “DD”) could provide.

But if Trump is not a party to the contract — and Schwartz has admitted he was not — Trump cannot provide such a warranty. Thus, Daniels was “materially induced” to sign a contract with a false promise. In other words, Schwartz’s definitive statement that Trump was not a party greatly increases the chances that a court will invalidate this contract.
Even if a court decided the contract is valid somehow, Schwartz’s claim that the president is not a party to it does significant damage to Trump. The case is now in federal court. Trump and Cohen are seeking to avoid having to sit for a deposition, or be subject to additional discovery, by pushing the dispute back into secret arbitration.
But the contract only allows Trump, not Cohen’s shell corporation, to resolve disputes in arbitration under section 5.13 and 5.2 of the agreement. Trump can’t take advantage of an arbitration agreement that he is not a party to and knows nothing about.

Da se je Bolton po mafijsko znebil direktorja OPCW morda ni povsem v temi, je pa toliko bolj zanimivo. Tovrstna politika ustreza tudi Rusiji, saj avtomatsko ruši vsa zavezništva, ki ZDA delajo za velesilo.

Jp, ne si domišljati, da je svet zabredel v vse to s Trumpom. Težave so bistveno globlje in segajo v same temelje ustroja ZDA, EU in zahodnega sveta. To je težava demokracije, če ji lahko tako sploh še rečemo. To seveda ni težava avtoritarnih sistemov, zato nam Rusija in Kitajska nista tako nevarni, kot se zdi. Najbolj nevarna zahodnim državam sta razgradnja demokratičnega sistema in drsenje v fašizem (korporatizem).

Walter Litvinenko, 71, arrived in Italy in April 2008 with his wife, Lyuba. Their daughter Tatiana – Alexander Litvinenko's half-sister – and her husband and their two children followed eight months later, joining Walter's son Maxim Litvinenko, his wife and young daughter. At this point the Litvinenkos applied for asylum.
At the same time they opened a restaurant in the tourist resort of Rimini. Maxim Litvinenko, who moved to Italy nine years ago, is a professional chef. But soon after opening their business, and securing local permissions, the police informed them they were operating illegally, with one room lacking planning permission.

The restaurant, La Terrazza, was finally shut down in November. The Litvinenkos were forced to move to a cheaper flat down the coast in nearby Senigallia.

Italian immigration officials have interrogated the family twice. According to Tatiana, they expressed little interest in why the Litvinenkos fled their home in the southern Russian town of Nalchik. Instead, they wanted to know how they had come to Italy and whether their visas had been forged.

Most Russians associate a municipal authority with a long wait. That made it even more surprising to Dmitry Kovtun, 41, when, after arriving on Monday, October 30, at the city hall in Hamburg's Altona neighborhood -- a classic structure with a view of the Elbe -- he only had to spend a few minutes submitting his application for a permanent residency permit. He signed a form, and that was it.
But his signature was not the only thing Kovtun left on the form. He also left a passport photo -- one that investigators have confirmed was contaminated with the deadly radioactive rays of Polonium 210.
The contaminated photo from Altona is now playing a central role in the British investigation into the mysterious death of former KGB agent Alexander Litvinenko. They believe the Kremlin critic was poisoned with Polonium on Nov. 1 in the bar of London's Millennium Hotel. And because Kovtun's application with photo was officially dated, they now know that the Russian from Hamburg already bore traces of radiation two days earlier.
